AI Risk Disclosure & Shared Responsibility

Artificial intelligence can create speed and leverage, but it is probabilistic technology—not a perfect employee, professional adviser, security control, or guarantee of any outcome. This disclosure explains the risks you accept and the safeguards you remain responsible for when using services configured or provided by AI Worker Agency.

Effective date: September 12, 2026  •  Operator: AI Worker Agency  •  Governing law: Georgia, USA

Important: This page forms part of the agreement between you and AI Worker Agency. By purchasing, accessing, connecting, or using an AI-enabled service, you acknowledge these risks and agree to the allocation of responsibility below, together with our Terms of Service and Privacy Policy.

Quick navigation

1. Scope and relationship to other terms

This disclosure applies to AI assistants, receptionists, chatbots, agents, automations, prompts, workflows, integrations, knowledge bases, generated content, and related consulting or implementation services that AI Worker Agency provides, configures, recommends, or supports (collectively, the “AI Services”).

If this disclosure conflicts with a signed order form or services agreement, the signed document controls for that conflict. Otherwise, this disclosure supplements the Terms of Service. Mandatory rights that cannot legally be waived remain unaffected.

2. Inherent AI risks you acknowledge

AI Services may behave unpredictably even when configured and tested carefully. You acknowledge that risks can include:

Incorrect output

Answers may be false, incomplete, outdated, fabricated, inconsistent, or unsuitable for the context.

Security manipulation

Attackers may use prompt injection, social engineering, malicious files, links, or connected data to influence an AI system.

Privacy exposure

Sensitive, confidential, personal, or regulated data may be revealed, retained, transmitted, or processed unexpectedly.

Bias and harmful content

Outputs may reflect bias or produce offensive, unsafe, discriminatory, infringing, or otherwise harmful material.

Automation mistakes

An agent may misunderstand intent, take an incorrect action, miss an instruction, contact the wrong person, or duplicate an action.

Service disruption

Models, APIs, phone systems, hosting, connectors, vendors, or data sources may change, degrade, suspend, or fail.

No AI system is error-free, attack-proof, or guaranteed to produce a particular business, financial, legal, security, or operational result.

3. Customer responsibilities and required oversight

You control the purpose, users, source data, permissions, approvals, deployment environment, and business decisions surrounding your AI Services. You are responsible for:

You remain solely responsible for decisions and actions taken by you, your personnel, your customers, or third parties based on AI output, except to the extent applicable law expressly provides otherwise.

4. Restricted and high-impact uses

Unless AI Worker Agency has expressly agreed in writing to a compliant, human-reviewed workflow, you must not use the AI Services as the sole basis for decisions involving employment, housing, lending, insurance, education admission, healthcare, legal rights, public benefits, biometric identification, emergency response, or other decisions that may materially affect a person’s rights, safety, livelihood, or access to essential services.

The AI Services are not a substitute for a licensed lawyer, doctor, accountant, financial adviser, cybersecurity professional, emergency dispatcher, or other qualified professional. Never use an AI Service to contact emergency services or to provide a guarantee of legal, medical, financial, safety, or security outcomes.

5. Third-party models, platforms, and integrations

AI Services may depend on third-party providers for language models, voice, telephone, messaging, email, calendars, payments, customer-management systems, hosting, analytics, or other functions. Those providers operate under their own terms and privacy practices.

AI Worker Agency does not control and is not responsible for a third party’s models, content, outages, security, data handling, policy changes, rate limits, account suspension, feature changes, or acts and omissions. We may replace, remove, or reconfigure a dependency when reasonably necessary, but uninterrupted compatibility is not guaranteed.

6. Security and incident allocation

We may apply reasonable safeguards appropriate to the agreed scope, but no safeguard eliminates all risk. Security also depends on your devices, personnel, credentials, permissions, data, vendors, configuration choices, and response speed.

You are responsible for losses caused by compromised credentials under your control, excessive permissions you approve, unpatched or misconfigured customer systems, unauthorized customer data, instructions or content supplied by you, failure to follow documented safeguards, or your continued use after a risk notice—except where the loss was directly caused by AI Worker Agency in a manner that applicable law does not permit us to exclude or limit.

Both parties will use commercially reasonable efforts to cooperate on containment and investigation of a confirmed incident affecting the AI Services. Cooperation does not constitute an admission of fault or liability.

7. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AI SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

AI Worker Agency disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, compatibility, and any warranty arising from course of dealing or usage of trade. We do not warrant that outputs will be correct, lawful, unique, unbiased, confidential, or free from harmful material; that every threat will be detected or prevented; or that the AI Services will produce revenue, savings, leads, appointments, conversions, or any other result.

Any written service commitment in a signed agreement applies only as expressly stated there. Nothing on a sales page, demonstration, forecast, example, or conversation creates a warranty unless included in that signed agreement.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI WORKER AGENCY AND ITS OWNERS, PERSONNEL, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT SUCH LOSS MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO A CLAIM WILL NOT EXCEED THE FEES YOU PAID TO AI WORKER AGENCY FOR THE SPECIFIC AI SERVICE THAT DIRECTLY GAVE RISE TO THAT CLAIM.

The limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit payment obligations, your indemnification obligations, or liability that cannot legally be excluded or limited. Some jurisdictions do not allow certain exclusions, so a limitation applies only to the extent permitted there.

9. Customer indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless AI Worker Agency and its owners, personnel, contractors, and suppliers from third-party claims, damages, penalties, judgments, and reasonable legal costs arising from: (a) your content, data, products, claims, instructions, or customer interactions; (b) your unlawful, unauthorized, negligent, or prohibited use of the AI Services; (c) your failure to obtain required notices, consents, permissions, or licenses; (d) your violation of another person’s privacy, publicity, intellectual-property, consumer, or contractual rights; or (e) your material breach of this disclosure or the Terms.

We will provide reasonably prompt notice and allow you to control the defense, provided you may not settle a claim in a way that admits wrongdoing by or imposes non-monetary obligations on AI Worker Agency without our written consent.

10. General legal terms

Governing law and venue

Except where mandatory law requires otherwise, this disclosure is governed by Georgia law, without regard to conflict-of-law rules. Venue for a dispute will be in the state or federal courts located in Georgia, subject to any dispute-resolution provision in the Terms of Service.

Severability and survival

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Risk acknowledgments, warranty disclaimers, liability limits, indemnification, and payment obligations survive termination.

Changes

We may update this disclosure prospectively by posting a revised effective date. Material changes will apply as permitted by the Terms and applicable law. Continued use after an update constitutes acceptance where legally permitted.
